Questions about the Free Debt Analysis

What will I get out of the free debt analysis?

You will meet with an attorney and to determine if you are eligible to file bankruptcy and what will happen to your bills and assets if you file bankruptcy. Also, you will discuss whether credit counseling, bankruptcy, or work out (which is a payment plan) is best for you or if you are judgment proof (which means that you can’t get blood from a stone or turnip, i.e. you have no garnishable income or assets that a bill collector can levy.

What will happen during my free debt analysis?

You will spend approximately one hour filling out paperwork and watching an educational movie about bankruptcy and credit problems. Then you will meet with an attorney for approximately one hour to discuss your options. Finally, you meet with a staff person for approximately five minutes to discuss your next steps.

What should I bring to my free debt analysis?

You must bring all of the following to your appointment in order for the Attorney to be able to give you the best advice about your personal financial situation. If you do not have at least the items with asterisks (*), then our office will not be able to file the Bankruptcy as per federal law.

  • Copy of your Drivers License or Passport and Social Security Card*
  • Credit Counseling Certificate*
  • Copy of last six months of pay stubs*
  • Copy of last four years of filed federal income taxes*
  • If applicable, copy of the foreclosure notice*
  • If you are buying a house or land,
    • bring a tax statement that shows the value of the property. (This will give the Attorney a general idea of the value of your real property.)
    • the Recorded Mortgage and Warranty Deed, which you can obtain by going to your Register of Deeds Office at the County Building.
  • Copy of all Titles to the vehicles and or mobile homes in your name.
  • Copy of last three months of bank statements for all accounts
  • Second form of identification (one of the following): Utility bill, credit card statement , canceled check, proof of insurance card, pay stub or car registration (this item must have your name and address on it to pull your credit report)
  • If you are being sued by a Creditor, bring in the Summons, Judgment, Garnishment, or whatever document you may have.
  • If you are divorced (within the last four years), bring a copy of your Judgment of Divorce.
  • You will need to list ALL your debts. Debts such as your house, car, or other debts that you say you “do not want to file on” must be listed. The Attorney must know ALL debts, and can then advise you which debts you may be able to keep. If you have bills that have been sent to a collection agency, please list the Creditor’s address separate from the collection agency. ALL ADDRESSES MUST BE COMPLETE WITH STREET NUMBER AND ZIP CODE.
